UJ law expert on ‘good faith’ in insurance contracts

A Professor in Private Law at the University of Johannesburg (UJ), Daleen Millard, addressed an international panel of law experts at a conference recently held at the University of Exeter in the United Kingdom. Prof Millard is Vice-Dean at the UJ Faculty of Law.

The question whether or not the concept of ‘good faith’ should be part of English contract law, took centre stage as leading academics, practitioners and policy experts explored competing arguments, offering both an international perspective and a consideration of the special rules applicable to insurance contracts.

“Good faith requires contractual parties to adhere to reasonable commercial standards of fair dealing, the agreed common purpose of a contract and reasonable expectations arising from it. Although the approach has not so far met with favour in the Court of Appeal, it is widely recognised in other jurisdictions—across Europe as well as further afield in Australia, Canada and the United States,” said Prof Millard.

The event at the Innovation Centre, University of Exeter, South West England, United Kingdom, took place on Saturday, 29 July 2017.
